Terms & Conditions

These Terms and Conditions ("Terms") govern every sale of goods and services by Industrial Direct Marketing Limited, trading as IDML Workwear, registered in England and Wales under company number 03117671, with its registered office at East Quay, Kite Hill, Wootton Bridge, Isle of Wight, PO33 4LA ("IDML Workwear", "we", "us" or "our"). Placing an order with us means you accept these Terms.
1. Definitions
- Customer, you, your: the individual or business placing an order.
- Goods: the products and services we supply.
- Order: a request from the Customer to buy Goods.
- Contract: the agreement between IDML Workwear and the Customer for the supply of Goods, on these Terms.
- Standard range: products listed for sale on our website, other than personalised, decorated or specially sourced items.
2. Placing an Order
2.1 An Order is placed through our online store or confirmed to us in writing.
2.2 Any change to an Order, including artwork or design changes, must be sent to us in writing. Changes may affect the price and the delivery date.
2.3 Where an Order needs new artwork, production will only start once you have approved the proof in writing. Please check proofs carefully, as we will produce exactly what you approve.
2.4 We may reduce, amend or cancel an Order at our discretion, and will tell you if we do.
2.5 We may decline or cancel any Order that breaches these Terms or includes material that is offensive, unlawful or infringes another person's rights.
3. Prices and Payment
3.1 Prices are those shown at the time you place your Order. Prices may change without notice before an Order is placed.
3.2 We take care to price our Goods accurately. If a pricing error is found, we may correct or cancel the Order, even after we have confirmed it, and will contact you as soon as we can.
3.3 Unless we have agreed credit terms with you, payment is due when you place your Order.
3.4 Business customers with a separate pricing or supply agreement should contact their account manager. These Terms apply to all Orders placed online or by phone outside such an agreement.
3.5 Prices and product details on our website are an invitation to place an Order and do not by themselves form a Contract.
3.6 Where credit terms have been agreed, invoices are payable by the end of the month following delivery. For business customers, we may charge interest on overdue sums under the Late Payment of Commercial Debts (Interest) Act 1998 until payment is received in full.
3.7 Goods remain our property until we have received payment in full.
4. Delivery
4.1 All Goods are subject to availability.
4.2 Delivery takes place at the address you give us unless we agree otherwise.
4.3 Delivery dates are estimates. We will always try to meet them, but for business customers we are not liable for late delivery.
4.4 Please report any shortage, damage or incorrect item by phone within 48 hours of delivery, and confirm it in writing within 3 working days.
4.5 If you ask for Goods to be left in a safe place or with a neighbour, the Goods are your responsibility once left there.
5. Returns and Refunds
5.1 Standard range products may be returned within 30 days of delivery if they are unworn, unwashed, in their original packaging and in new condition.
5.2 If we send you incorrect, faulty or damaged Goods, we will pay the return carriage.
5.3 We cannot accept returns of embroidered, printed, personalised or otherwise decorated items, or special-order and non-standard items, unless they are faulty or we have made an error.
5.4 Where Goods are faulty, we may repair or correct them before offering a replacement or refund.
5.5 Returns that do not meet these conditions may be refused and sent back to you, or repackaged at your cost.
5.6 Full details are in our Returns Policy. Nothing in these Terms affects your statutory rights as a consumer.
6. Discounts and Promotions
6.1 Discount codes apply to online Orders only and cannot be combined with bundles, wearer packs or other promotions.
6.2 We may withdraw or refuse a discount at our discretion.
7. Product Information
7.1 Colours on screen may look slightly different from the actual garment.
7.2 Please use our size guides before ordering. Items ordered in the wrong size cannot be returned once decorated.
7.3 Where products are offered without VAT under a relief, you are responsible for confirming that you qualify when you order.
8. Intellectual Property and Artwork
8.1 All content on our website, including text, images, graphics and logos, belongs to IDML Workwear or its licensors.
8.2 You may not copy, reproduce or use our content without our written permission.
8.3 By sending us artwork, logos or text, you confirm you have the right to use them. We may decline any Order that includes copyrighted, offensive or unlawful material without proof of permission.
9. Liability
9.1 For business customers, we are not liable for any indirect or consequential loss, including loss of profit, business or goodwill.
9.2 Our total liability for any Order will not exceed the price paid for that Order.
9.3 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded by law, including your statutory rights as a consumer.
10. Events Outside Our Control
We are not responsible for any delay or failure caused by events beyond our reasonable control, such as strikes, transport disruption, severe weather, supplier shortages, pandemics or government action.
11. Cancellation and Refusal of Service
11.1 We may end a Contract or refuse service if you breach these Terms, if payment is not made, or if an Order is offensive, unlawful or inappropriate.
11.2 Ending a Contract does not affect any rights or obligations that already exist.

13. Governing Law
These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
